I am on L2, working in local US company with valid EAD. My husband is on L1B and our visa's are expiring 31 May 2012. My company is ready to file H1B for me and my husband's company has also said they will now file H1 for him, instead if extending the L1B. What is the procedure for my company for converting the present L2 to H1B. What is the cost involved? Does my company need to apply now or wait till April 2012 to apply for the visa, for me to continue working after expiration of my current L2 visa. I have a graduate engineering degree and have worked with my current employer for 10 months. Any advice will be highly appreciated.

Apply now for H1B FY2012, H1B cap is not yet filled. Your company has to file L2 to H1B COS. Cost is the same for a new H1B (check www.uscis.gov/h-1b_count). There is an option to mention the future date employment like you can file an h1 now for job starting 3 months later. I dont know till what future date employer can file ( i guess its 6 months).
