  • Question regarding Premium processing timelines

    My H1b case was upgraded to Premium on 9th Nov. The 15th calendar day happens to be 24th Nov which is a holiday and an extra long weekend. What is the exact rule about the timeline in such case?

    Will USCIS will have to provide the desicion before 24th or does the timeline rule allows them to respond after holidays even when it crossed 15 calendar days deadline.

    The 15 day count starts after USCIS takes receipt of the premium form. Receipt date can be 1 or 2 weeks from the actual physical delivery date.
    If USCIS does not make a decision or send an RFE within 15 days of their receipt date, they will refund the fee.
