  • I-94 expiring, filed for H1B extention. Want to visit India.

    Hi,

Thank you for reading this post.

I am currently in US on H1B visa.
    - My I-797 is valid till Oct 2013.
    - Visa stamp expires in Oct 2012.
    - I-94 expires in Jan 2012. (Probably because my passport was expiring in Jan 2012. I already got my new passport valid till 2021.). I have already filed for H1B extension to take care of it as suggested by attorney.

Assuming H1B extension will be approved, If I travel to India in say June 2012,
Do I need to go to US consulate for new Visa stamp? Or my current H1B stamp which is valid until Oct 2012 will do?

I have been given 221(g) twice earlier. Once for B1 visa in 2008 & again for H1B in Oct 2010. That's why I am concerned about going for visa stamping & getting stuck due to 221(g).

    Please help.
    Thanks.

You can enter U.S as long as your current visa is valid. Carry both the passports when you travel.
