i-485 filing need urgent help

Hello all.
i applied for h4 after 4 months its got refused and husband petiiton sent back to uscis but till date no update from uscis.and today with visa bull my husband GC dates becomes current its dec 2008,and now my question is:

1..as his petion is under review but no update from uscis so can he file his i-485?
2..as i am out of country this time so can he put my name on his i-485 process.
please suggest
