  • H1 query

    Hi,

I have a M.S in industrial Engineering from University of Texas at Arlington. I am working for a Telecom company and have 8 + yrs experience in Telecom. My employer wants to apply for H1 for me on April 1 2012. Is my educational background an issue. I completed my M.S in 2002. One more question is will i be able to apply under Masters quota. Also is it easier to get H1 approved under Master quota.

    Any pointers will be appreciated.

    Thanks,

    Sujeet

Master's quota is just another 20,000 cap numbers that are available to US advanced degree holders only. Having a US Master's degree does not make H1 filing easier or more difficult. few years ago when general cap was being met on the first day of filing, having a Master's degree meant that one could file even after general cap was met. However, in recent times general cap has remained open for months after Apr 1 and hence it makes no difference having a US advanced degree.
If you have a Master's or higher degree from an accredited US institution, you can be counted under advanced degree exemption.
This is my opinion and not legal advice.

It is a combination of education + experience. You need to go for an educational evaluation. You will find details about that in the link that I have provided.
