Expired petition - Does quota apply

Hi,

I have a H1b on COS from L1B. I was unable to return to US the last time i came to India. Now , my H1B petition has expired. I have heard some where that I will be exempt from the Quota if some one is applying for my H1b again , as i have a petition number already. Is this true?

is there any thig that i can cheer about in the situation i am in ?

Yes .... IF you have the petition approval ( i 797 ) copy ...or atleast the petition number give it to your employer . if you can provide the above ...you are cap exempted
