    Hi All,

    I came to USA on H4 and then applied for H1 valid from October 2008 till September, 2011. After working for 1.5 years I did COS to H4 for personal reasons. Now I have a very nice job offer and want to get back on H1B but the employer is diffrent. Also my previous H1B expired in September 2011.

    Since, I am Cap exempt how can I get my H1B?
    Do I have to file new H1B as previous one expired and employer is also diffrent?
    What documents are needed from my end?

    >>> Any employer can file a new H1B petition using the CAP from the previous H1B petition as a COS from H4 to H1B and request an immediate start date. You can start working if the petition gets approved with a new I-94.

    What documents are needed from my end?
    >>> The same set of documents that you submitted for your first H1B petition. Your employer will let you know what they need.
