Regarding H4(my Wife and Kid)

Dear Team,

I have question regarding my wife and kid(H4) visa.

My new company started H1transfer and it is inprogress, and my motherinlaw not well, I am sending my wife and kid to india on this month end.

Can I send them?

Yes. When they return back, they will need the approval notice of the company which you will be working at that time to show at the POE.

Thanks for reply, usually company will apply for H4Transfer and I94, if they are in not in country, then my drpendents will get only approval notice H4 only right or not I94?
Please give little overview on POE , is this board of entry?

There is no such thing as H4 transfer. H4 is not asociated to any of your employers. Usually the comapnies apply for H1B to H4 together so that the family has their I-94 expiring on the same day. It doesn't m,ean that your should keep applying H4 for your dependents everytime you swicth comapnies. It can be filed only when the existing I-94 is about to expire (6 months prior to the expiry date).

When the dependents are outside U.S, there is no need to file form I-539. If you file it, it is just useless. POE means port of entry (If you are returning by flight, then U.S immigration in the international airport). By showing your latest approval notice, the dependents can get their I-94 matching your I-94 expiry date.
