  • Need help on Documents required for H1B Stamping

    Hi, I am working in India as a Software Engineer and I bagged an offer in US, my new Employer from US has filed my H1 Petition and it got approved. I have schedule Visa appointment in hyderabad and it is in next month Jan 2012, I have some questions regarding the documents i need to carry, my Employer has sent me a Verification letter specifying that I was hired as YYYY XX and offered a permanent Position. He didn't mention anything about the Client for whom I am going to work, I am worried if Visa Officer asks for Client letter and regarding the project that I am going to work there. I asked my Employer regarding this but I got an answer that as I am a direct employee i don't need any Client letter.

    Can anyone please let me know in which case does Visa officer ask for Client letter, by looking at my case can anyone tell me into which category do i fall EVC or EC.

    Please help me in this

    Will you be working directly for your employer at their work location? If yes, and if theproject is managed by your employer, then you don't need a client letter. All that you need is the project internal documentation, the details about the team that will be working on the project and who manages it. If your employer is a pure consulting firm and if you will be working at a different location other than your employer (at a client place), then you need a client letter.

    Check these details with your employer and they should be able to let you know whether you will be working at a client location or not. You should be working at the location mentioned in your LCA and I-129.

      Documentation Required

      Hi,

      Can you please tell me what other documentation would be required, if my employer is a consulting company.

      In my case, I was working for Employer A for a client and my H1 Extension got denied. During this process my I-94 also expired. Employer A re-applied for H1 under nunc-pro-tunc, but even that had a RFE on it. In this time I approached Employer B, who filed my H1 for the same client, as I got new Client and Vendor letters. My H1 got approved now.

      Apart from Client and Vendor letters, Do I have to carry any additional documents like PO, SOW between client and Vendor letter? I am not sure if my Vendor would be ready to provide such documents. Are these required for sure? Wouldn't Client and Vendor letter be enough to show the Employee-Employer-Client relationship?

        You will need the client letter, vendor letter and an employment authorization letter from your employer.

          Yes I will be working at my Employer location only and the project is handled by my Employer only, I have some information regarding the project like who are the people going to work with me and to whom i am going to report to, do i need to know some more about the project as well?

            The VO might expect to see some documents about the project. Rather than you knowing the project details, it is better to have them in paper, so that you can hand it over to the VO if asked. Get this from your employer.

              Thanks for the reply Shervin, I got the documents regarding my project, my Employer has sent me I797B original document and all the remaining docs I129, LCA, project docs, Employement authorization all are duplicate Scanned copies, I asked my Employer for the originals but I got a reply that they have submitted them in the USCIS all the originals are with them it seems, my doubt is can I attend the Visa stamping with these duplicate copies.

                Your employer is right. I-129 will be sent to USCIS and ofcourse it will be a duplicate copy that the employer has. Original I-797 is what is important. The remaining can be photocopies.
