  • Mismatch Between I-797 and H1B visa data

    Hi all,

Last month my wife had got her H1B visa. Initially she had received 221 g but got the visa 3 weeks later. Though her I-797 is approved for 3 years, the visa is valid only for two years. Can anybody let me know what it means? Why visa was approved only for two years. This was first time she had applied for H1B.

    Thanks,

    Sachin

It is hard to tell why the visa was issued only for 2 year when the petition is valid for more than that. It is possible that the outcome of the admin processing would shown that the project really exist for only 2 years. Anyways, visa is only an entry document to U.S. Hopefully when she enters she will get an I-94 until the petition expiry date and I-94 is what is import to legally stay and work in H1B status in U.S.
Not a legal advice. Use of this information is strictly at your own risk.
