    Hi -

    I am in the process of transferring my H1 status to company B from company A, and would like to extend my joining date with B about two weeks after my relieving date with A. During this two-week period, I intend to travel outside the US.

    I have the following question about this scenario -

    Can I enter the US after my vacation to join B, with my previous non-expired H1 visa stamp (stamped when I was with company A), and the H1 filing receipt from company B? I would most likely not have the new I797 when I enter the country.

    Are there any other potential status issues with this scenario, that I should take into account?

    Any responses are much appreciated.

    You can definetely re-enter with company A's non-expired visa. But it is not advisable to enter back with just comapny B's receipt notice. That is a big risk. Infact, it is not advisable to leave the country when the petition for transfer is pending iwth USCIS.Wait until the petition gets approved and then re-enter back. A premium processing will get you the result within 15 days.
