A person consumed 6 years of his H1 and his I 140 was approved by the end of 6th year completion and is out of US for some time (less than a year).
Can you please guide me with regards to the below listed.
Can he avail AC21 even if the petition is not filed before the lapse of the 6th year ? i.e., can the same employer or a different employer files his petition under AC21 portability under Non-Quota after consuming 6 years completely by the beneficiary? Is there any time limit within which an employer has to file the petition in order to utilise AC21? If the same employer files the petition, will it be called a "New Employment" or will it be an "Extension"?
