    Greeting immigration Experts,

    I had an H1b petition that was valid from 10/04/2005 to 10/01/2008. H1b visa was stamped on my passport and i travelled USA two times and work for total 6 months. After i returned from the second visit in March 2007, i never got the oppurtunity to work again in US. In october 2008 i resigned from the company which had filed my petition. They took my passport from me adn got it stamped "Cancelled without prejudice" on my visa from US consulate in india.

    I would like to ask to the expert panel, since i have already maintained H1 status, am i eligible for the cap-exemption if another employer files a new petition now? If yes, then for how much period will i granted for ?

    Please advise ,

    Yes, you can use the CAP from the previous H1B petition to file a new one. You will get 6 years minus whatever time that is already spent in U.S in H1B (+ L1) status.
