L1B Visa get rejected on 20/01/2012.Wanted to apply H1B visa immediately

Hi,
My L1B Visa got rejected on 20/01/2012 by Chennai consulate.VO said your specialization is not clearly approval under this category under section 8 CFR 214.2(I)(ii)(D).Handed over to me Blue slip 221(g).Ask your HR to apply other visa type.Now i wanted to know that can i apply H1B visa immediately once cap is opened.Is their any time frame will be ?.And L1B individual also can i apply immediately. ?Please let me know

H1B Visa Cap will open only in April 2012 and you can work only after 1 Oct 2012. L1 individual can be filed immediately. This is my opinion, please do consult your company attorney too.

Thanks for prompt response.If i will apply under premium process for H1B in April2012 then i can work before Oct2012.

H1 B under Premium or normal processing will not change the start date. The start date has to be on or after 1st Oct 2012. This is my opinion, please do consult expert opinion too.If still in doubt check with your company's immigration team.
