L2 to H1B

Hi,

I am currently working in company ABC from Dec 2008 in L2 Visa. My L2 visa is valid till April 2014. I applied H1B (COS) through company XYZ and got approved on Jan 23 2012. I am planning to go to India from March 2012 till April 5th 2012. Please clarify the below,

1. Can I travel to India on my L2 Visa as my H1 is approved with Change of status or do I have any conflict of status at port of entry when I come back?

2. XYZ Company advises me to travel in L2 and they ask me to join after coming back from India. (i.e re-entering US on L2 Visa- After Apr 5th). Is it a right way to do?

3. Can I continue with company ABC till I come back from India (till April)?

You are on H1B status now and NOT on L2 anymore.

You should work for the H1B sponsor company now. If you travel outside the U.S., you will need to get your H1B visa stamped in the passport before entering back into the U.S.
