  • L1B to H1B & employer change

    Hello,

I have the following situation. My extension of my L1B visa will finish in
    August 2013.
I would like to change the employer and that new company would need
To apply for a H1B visa.
I have an interview set up already for next week.

The question is when could I start working for a new company earliest
Provided they sponsor a H1B visa? And based on all the timelines to look
After for this kind of visa?

How long could the overall process take till I would receive a H1B
    Visa?

    Thanks for your input

If you have never been counted under H1 cap before, the earliest start date for H1 is Oct 1. You cannot begin working for the H1 employer before that. Also, since your current status does not extend up to Sep 30, you will either have to file L1 extension or leave the US and return in H1 status on Oct 1.
This is my opinion and not legal advice.
