  • H1B and H4 in parallel

    Hi,

    I plan to apply for H1B in April, 2012. Most probably the approval will be out by August, 2012 (approx). My wife is also applying for H1B during the same period.
    My questions are (assuming that my H1B and my wife's H1B, both get approved):
    1. If my wife's H1B get approved and she flies in Oct, 2012 then can i apply for H4 (as a dependent on her H1B) in parallel (and still keep my H1B approved).
    2. If the answere to the above scenario is yes, then after moving to US (on H4) can i get my H1B transfered to another employer and start working there?

    >>> Yes.

    >>> Yes. A COS from H4 to H1B will have to be filed. You cannot work until the COS gets approved (the approval should come with a new I-94 for you to start working in H1B status).
