    Hello,

    1. Non Exempt Employee with Non Profit Company
    If One (Non Exempt worker) gets H1B from Non Profit company.
    Can one transfer H1B from that company to other Private company?


    2. Non Exempt Employee with Private Company
    Kindly briefly could I get know, in same case but the company is Private Company?

    Looking forward to hearing from information source.

    >>> No. You will have to go through CAP if you want to work for a non-profit company. The CAP should remain open for you to file a petition for the non-profit company.

      I am confused between non exempt employee and cap exempt term.
      if one is a non exempt employee can he have H1B filed under quota? (starting from april?)

        >>> There is no such thing as "non exempt employee". Certain non-profit organizations (employers) are excepted from CAP. Meaning, they don’t have to wait for the quota to open to file an H1B petition.

        >>> Again, there is no such thing as “non exempt employee”. If your question is whether a CAP exempt employer file a H1B for a candidate under quota instead of filing the H1B petition as an exemption from CAP, then the answer is YES.
