  • Question On H1B Extension

    Hello EveryOne,

Got Question On H1B Extension. Had a H1B Visa which got expired last September.. I am in my home country now.
    1. Can i extend that Visa now or should i file a new H1B petetion
    2. Will i be considered in 60,000 quota?
      • If i file a new Peteion?
      • If i go for an extension

    Thanks,
    Murali

    >>> If the job is still available in U.S and the H1B sponsor is ready to provide you the required documents for stamping and if your H1B petition is still valid, then you can apply for the H1B visa at the consulate. If the petition has already expired, then an extension need to be filed.

Will i be considered in 60,000 quota?
    >>> No. You can use the CAP from your previous H1B approval notice (assuming you did not use all 6 years in that CAP H1B + L1 combined by working in U.S)
Not a legal advice. Use of this information is strictly at your own risk.
