!!! URGENT HELP !!! - H-1B extension CAP?

I am applying for an extension of my H-1B (first extension) without changes in employment. Is the extension petition considered Cap Exempt since the original visa was counted towards the cap?

There is a question about this in the I-129, Page 18, Part C, Question 1.

I need to send my petition on Saturday so I am pressed for time. Any help would be greatly appreciated!!!

Yes, it is cap-exempt. I am sure your employer or their lawyers will handle this. This is not your petition, it is your employer's.

Do you know if all cap exempt cases need to be submitted to the California Service center, or is this a case where I need to submit it to the Vermont center (Since we are in DE)?
