my I140 denied in Oct 2011; lawyers have apealed the case and preparing to file a new case.

my h1 expires sep 2012; lawyers filing h1b extension based on appeal of denied i140

can i change job now with same company based with this scenario

No. You cannot transfer the H1B beyond the 6th year without a copy of an approved I-140.
