L1 expiring can I apply for H1

Hi,
My L1 B visa is expiring in May 2012 but my I-94 is valid till August 2013.

Can I apply for H1 this year even when my L1 is expired but with valid I-94 ?

Yes (Provided you haven't completed all 5 years in L1). Your I-94 determines when you status legally expires. L1 + H1B together is for 6 year.
