    I got H1B visa stamped in 2009.My H1b visa petition was expired in 2011.US employer has cancelled the visa in Mar'10

    My present company is planning to apply the H1B vias for the FY2013.

    Instead of applying new visa,can I extend the old visa?

    If extended, may I know the procedure for it.Will the H1B cap come into picture I want to transfer/extend the old visa?

    How good are the chances in the Hyderabad/Chennai embassy if I go with the old visa?

    Do I require any documents from previous sponsored company to submit for the extension of visa?

    Provide your employer with a copy of the previous petition approval notice. Using that they can file a cap-exempt petition and request immediate start date. The only difference is that you will not have to wait until Oct 1 start date that way. After petition approval, if the Visa in your passport has not expired at that time, you can travel to US and work. Otherwise, you will need to apply for Visa at a US Embassy/Consulate like before and then travel to US. The total duration of stay in the US in H1 status will be 6 years, including any stays with the previous petition.
