  • I-94 date less than H1 expiry date

    My H1(extended already) is expiring in 2013, when I and my wife came in June, 2012, the I-94 was given only till Dec. 2012.

    Any clue why they have done it this way? and what is the best process to get it extended? In her H4 passport also, the validity is till 2013. Please help.

    Did both of your get the I-94 only till Dec 2012 or just your wife. If it was just your wife, then what is her passport expiry date?

      If the latest petition expires in 2013, the I-94 should match that. Unless your passport expires earlier, if that is the case you need to get your passport renewed first.
      In order to extend I-94, you can try visiting CBP deferred inspection post at nearby airport. This may or may not work.
      If that does not work, either your employer can file extension or you can travel outside the US and return again to get appropriate I-94. Do one of these steps before the current I-94 expires.
