H1b Revoked by USCIS, will I fall under cap exempt if I apply for h1

Hi,

My H1from Emp A was valid till Oct'2011 and I had to visit india and went for stamping.I got Blue slip which finally revoked by USCIS on Nov 9, since my employer was not ready to provide the documents which the counsellor asked for, apart from that FDNA had visited my emp A and found about ilegal documentation.

Emp B(Direct client) is ready to sponser my H1, but only thing is he wants me to join ASAP.

Now my question is about will I fall under cap Exempt or do they have to file for new H1...

Yes, you will remain cap-exempt and your new employer can reclaim all the remainder time period from the 6 year limit.
