  • Travel to US from current org on valid H1B visa issued on my Previous employer's name

    Hello Everybody,

I have a situation wherein i'm required to travel to USA immediately.

I was employed with Org A and they filed for a H1B visa for me. It was approved and the stamping was also successful. I traveled to USA on that visa and worked with Org A for about 9 Months.

I came back to India and continued to work for Org A and quit them after sometime. In the mean time Org B filed for a H1B transfer under Cap Exempt and the transfer got approved. My Visa stamp with Org A on my passport is still valid for the next 6 Months.

I'm employed with Org B in india right now and they want me to travel to USA. I wanted to know if i can make use of the visa that i hold to travel to US. Would that be legal?

    Please help me.

    Thanks

Yes, you don't need a new Visa. Just use the current Visa and new approval notice. Make sure your I-94 at port of entry matches the new approval notice.
This is my opinion and not legal advice.
