Urgent question - My wife and Kid travelling while I94 expired.

Hi,

My wife and Kid are travelling to India on 15th May. 2012. Our H1/H4 extension petitions were applied on April 2012 in premium processing and received the receipts, but unfortunately we received an RFE and the extension is still pending.

Our I94s have expired on 7th May 2012.

Is there any problem in my wife's travel since the I94 has expired? I just realized this scenario and want a quick answer about this.

Will there be any problem while checking in if my wife provides a I94 which is expired?

There will be no issues traveling outside U.S with an expired I-94. However, it is not advisable to travel outside U.S when the extension is pending with USCIS. Search and read the posts that explains why it is not advisable.
