    After getting extension for h1b till dec 2014, we went to mexico and got our visas stamped. My daughter (h4) turns 21 on feb 2013 and her 797 approval is also till feb 2013, but still the VO at mexico stamped her visa till Dec2014. She also got her 1-94 valid till jan 2015.

    Now, will she be able to travel in and out of USA till the validity of her visa? Will she be able to continue to be in USA till Jan 2015 legally as H4?

    No. The responsibility of following the H4 regulation lies completely with the individual. She cannot stay as your dependent in H4 status once she turns 21. If figured out later, she will be in trouble. If she leave U.S and try to return back as your dependent after she turns 21, she will very well be stopped at the POE. It is better to find an alternate status to switch.
