  • Change of employer and H4 status dependents outside US

    Hi,

I heard that if you change the employer on H1B within 45days of arriving in US there is no need for pay stubs? is it correct ?

Also If I change employer within 45 days or after 45 days, what is the H4 status of dependents who are out side of US? Is their H4 is still valid? Will there be any issues at POE?

    Thanks
    Sri

Paystubs are needed to prove that you are currently maintaining H1 status. Sometimes USCIS asks for paystubs as late as date of filing the transfer.

Yes, their Visas remain valid until expiry. They will however need a copy of your latest H1 approval notice.

    Thanks

    See above.
This is my opinion and not legal advice.
