Need help in H1B Education Evaluation

Hello,

Currently I am in L1 and my employer is filing L1 to H1 this year, having education evaluation criteria issue reported by the employer.

After my SSLC, i have done 3 years of diploma in electrical engineering(DEEE) and then i did 3 years of bachelors engineering(BE) in computer science.

Currently i have totally 8.6 years of IT experience.

My employer is reporting that either you should have 4 years degree or 9 years of experience to file a H1 this year.

Is that correct ? will that not my diploma taken into consideration ?

My husband was on an L1 and he is applying for an H1 now. He had his Education Evaluation done a few weeks ago and he has no degrees or diplomas, but has 12yrs experience and this was sufficient on the 3 to 1 rule. Where three years of experience, equals 1 yr of education.

Do the evaluation, it's the only way you will find out if it's enough.
