Am I Cap Eligible

HI,

I have H1B petition that was stamped in 2008 and valid till June 18th 2011.
I did not travel on H1B Visa.
I traveled to US on L2 Visa in July 2011.
I am planning to apply for H1B Visa now.
Could you please help me to understand if I am Cap eligible or not?

You can get exempt from CAP by providing a copy of your previous H1B approval. Any U.S employer can file a H1B petition for you using the CAP from your previous H1B approval notice and request an immediate start date. You don't have to file your H1B under the 2013's CAP.
