  • H1B 221G Clearance Validity

    Hi,

I had my visa interview on feb 2011, was given 221G pink slip and asked me to wait. My 221G got approved and i was given visa on oct 2011. But my petition got expired soon after and my visa got void. Again a new H1B was filed for me and i am having my interview on July 2012. Will the last clearance is sufficient to provide my visa or there is a chance to 221G again.

    Thanks.

Everytime you appear for the visa interview, then reevaluate it as a new application. There are chances of 221g again if proper documents are not provided.
Not a legal advice. Use of this information is strictly at your own risk.

Is there any 221G security clearance validity period?

I appeared for my first H1 visa interview in 2007 and was issued my visa after having to wait for 100 days since my visa was stuck in Admin processing(Most probably because of Visa Donkey check). Second time I appeared for an interview in May 2011 I was again issued a 221G and got my visa just a few days back In Dec 2012 after waiting for 20 months.
Unfortunately the visa is valid only till Feb 2013 and my employer is asking me to go for visa stamping again with the new I-797 since I can go back to Us only in April 2013.
Is there any validity period for 221G clearance? If I go for another interview within a month or 45 days of my last visa issue is there a chance that they will look at my recent security clearance and issue me the visa without any admin processing?

As mentioned by the earlier forum member every time you appear for the visa interview there is possibility of Additional Processing. But if you have had a visa stamping very recently, you might be able to avail of the Visa Interview Waiver. Do check your eligibility for the waiver. But again, even if you are eligible for a waiver the consulate may still call you for an interview.

This is my opinion not legal advice.
