H1B - Cap exemption

Hello All,

I have applied for H1-B in 2007 and the petition got approved in 2008 Jan after a query, but haven't used it (not even applied for visa). I had H4 visa and currently on L2 EAD and working.

Can I be cap exempted this year with my older petition with my current employer? I only have the receipt number, not the original I797 petition.

Please advice.
