  • 221g administrative processing

    Hello,

I got 221g green and i submitted all required docs as per the query and after waiting for 6-7 months I got a call from VFS Hyd stating that I need to come to vfs to collect the documents.

They don't have any information from the consulate regarding my visa approval. passport is with me only and I did not get any call or email to drop my passport at VFS for visa stamping.

Please let me know what would be reason they sent back the docs to vfs.

Is the administrative processing completed?do I have any chances of getting an email or call from consulate to drop my passport in next couple of weeks?

I am in confusion about this situation ,please share if you have any these kinda of experience.
Please reply back to me when you get a chance.

    Thank You !!

It is very hard to say. Sometimes they return all the documents and will continue with the admin processing. If the visa is already rejected, then you would have got a letter mentioning that your petition is return back to USCIS for possible revoke. There are also cases where they return the documents that are already with them and request for more documents to proceed. It is very hard to say what is going on with your case. You have to go to the VFS and figure it for yourself. Hopefully everything will be okay.

                Hello Shervin,

Thank you for your response. If petition is return back to USCIS for possible revoke.

                I've some questions.
                1. Can I apply for a new h1b petition(h1b transfer to other employer)?, if Yes what will happen to my previous petition.
                2. Can my employer do withdraw this petition ? but as letter says USCIS will contact my employer regarding this case.what would be results?
                3. what best my employer can do about this situation. what are the ways my employer can manage this situation.
                4. pls let me know how can i get past this problem.?

Please suggest your inputs and others if you have this experience pls let me know how you are approaching to get rid of this problem.

                Your response is highly appreciated.
                Thank You!!

                  >>> Yes, you can file a transfer to a new employer. The previous petition will be pending review from USCIS. It will either be reafirmed or revoked.

                  2. Can my employer do withdraw this petition ? but as letter says USCIS will contact my employer regarding this case.what would be results?
                  >>> They can withdraw it if needed. But that is not necessary. USCIS will revoke it if needed. No one can predict what will be outcome.

                  3. what best my employer can do about this situation. what are the ways my employer can manage this situation.
                  >>> They can do nothing. If someone contacts your employer from USCIS, they should be able to answer properly.

                  4. pls let me know how can i get past this problem.?
                  >>> Transferring to another employer is the best option.

                    Hello Shervin,

It's been 8 months I am staying in India and I have a question.

1.what happened my visa application I-129 if I won't do a H1-B transfer to another employer within 1 yr?
2.The stamping scenario in India is very grim and that is a reason why employers are not looking forward to any stamping plans back in India. 221(g) has become very common here.I am not able to find a employer who can do a H1-transfer and support me with the visa stamping.
Can you please do let me know about some employers who can do a H1-b transfer when the applicant is in India.
3.If in case within 1 year period, there is no H1-B transfer done, can I have a chance of doing a transfer later in future. if yes, what happened to my previous application?
4.I read in the forums that having a H1-B and staying out of USA for more than 1 yr, If I reapply new H1-B petition or transfer, I will get complete 6 yrs for that petition. is it true?

Please give some suggestions, Your response is greatly appreciated.

                    Thanks!!

                      >>> Previous application will remain valid until its expiry date. After that it will expire.

                      >>> You will get complete 6 years only if you file the new H1B under a new CAP (new quota with Oct 1st as start date). If you use the old CAP for filing an extension or transfer, then you will get only 6 year minus whatever time that you have already spent in U.S.
