  • Changing employer on Receipt Notice

    Employer A has filed H1B petition in FY13 cap for my friend. She got the receipt number (but not the hard copy) and the status is still Initial Review. Once the petition is approved, if Employer A could not find any project for her in the preferred location, can she transfer her petition to Employer B based on the receipt number she got from Employer A?

    Yes. Most employer will be reluctant to file the transfer with just the receipt number though. If the employer gave her a wrong receipt number, the new employer will lose the filing fee.

      Is there any way for anyone (employee/lawyer) to know if the receipt number belongs to the intended person ?

        If you have a copy of the receipt notice, it will have your name on it. If you just got the number from the employer, then what is the proof that the employer gave you the right number?

          Yes exactly. Is there any way that can be verified. Can the new employer find this before actually filing the transfer?

            No. Getting a copy of the receipt notice from the old employer is the only option.
