  • Need InfoHelp - what are the consequences when my husband withdraws his H4 support?

    Facts of the case:
    I got married to my husband in June 2011, we stayed together till September 2011. After which, due to irreconcilable differences, we got separated. Subsequently, I left his house and shifted to my cousin’s place in New York. Two month after separating i.e. in November 2011, I shifted back to my home country.

    My questions:
    • What would happen if my husband withdraws his H1B support to my H4 visa while I was in the US? Say, he withdrew the H1B support in October 2011. Does my stay in the US becomes illegal from October 2011 to November 2011?
    • If so, how can I find it out online? Is there a way? There’s no point checking it with my husband, as we are not on talking terms and legal proceedings for divorce shall soon start as per the local laws of my home country.
    • Also, how would it affect my visa application process, if any, in future? Would that 1 month of illegal stay (if so, as stated above) be a hindrance for me in getting, say, Tourist Visa for the US in future?

    Appreciate your help, in advance.

    >>> There is no way to withdraw H4 by your husband. If you stayed in U.S in H4 status after your divorse, then that is an issue. You won't be able to travel back to U.S in H4 visa without your husband's latest doucments. If a divorse has been filed, then it is illegal to travel in your valid H4 visa.

    >>> There is no way to find out. There is no way for your husband to withdraw the H4. As long as you are married and divorse is not filed, you are still his dependent.

    There’s no point checking it with my husband, as we are not on talking terms and legal proceedings for divorce shall soon start as per the local laws of my home country.

    >>> No issues.

    >>> No issues as it is not an illegal stay.
    Not a legal advice. Use of this information is strictly at your own risk.
