    Hi,
    I want to transfer my H1 from the existing employer to the new employer. I've an agreement with my existing employer saying that I need to give 3months notice or need to pay 25K for the liquidated damages. Now my H1B transfer is in the process.

    If I don't give any notice to my existing employer and join the new employer, is there any possibility of taking legal actions by existing employer? Moreover I didn't get any pay for initial 1 month by the existing employer.

    It is possible for the employer to take legal action. It is very hard to say anything without knowing anything about what contract you have signed with the employer. It is always advisable to take the help of a labor attorney in cases like this.
