  • H1B Revocation from New Delhi Consulate

    Hello Experts,

I appeared for my H1B renewal at New Delhi consulate in Nov.2011 and my application was sent back to KCC. No news since then. I had applied for a new H1B with my vendor and appeared for visa interview at Mumbai consulate and got 221(g) with all the documents checked for employer and hand note asking for the proof that i have withdrawn visa application from New Delhi consulate.

Could you please help me with the process of revocation of H1B visa application from New Delhi Consulate?

Have already wrote an email to New Delhi VFS and waiting for the response from consulate from past 2 weeks.

    Thanks in advance.

Write a letter to the New Delhi U.S consulate mentioning that you would like to withdraw the visa application. Attach enough documents (221g copy, copy of H1B approval notice, DS160 confirmation number etc) to identify your application.
Not a legal advice. Use of this information is strictly at your own risk.

      Hi Shervin,

I did send the information to New Delhi consulate and got confirmation from them stating that they no longer working on my case. I submitted documents including copy of the email to Mumbai consulate.

Now i have got following email from Mumbai consulate after a week from my document submission -

      "Dear Sir:

Greetings from the Nonimmigrant Visa Section of U.S. Consulate General Mumbai.

Please follow the instructions regarding your pending visa application further.

Please contact USCIS and your old employer to have your prior petition (WAC- YYYY YYYY ) withdrawn. Your old employer can do this on your behalf or you can contact USCIS directly with this request. You should contact the California Service Center at 1-800-375-5283.

When the required action is completed, you may notify us at [email protected] so that we can provide you with further instructions regarding your application.

      Thank you,"

Can i consider these as good news and assume that i will get the stamping on new petition once i will withdraw the old petition?

Yes. Keep copy of this email for your records when you attend the visa interview with the new employer's petition.
