  • H1 transfer with one missing paystub

    Hi All,
I did CoS from H4 to H1. My H1 petition was approved on 20th Dec, 2011 but my first payroll ran on 4th March (for the period of 15th Jan - 30 the Jan) because of SSN and project delays, although I started working at client site from 15th Jan. So I got the payroll but it was delayed by more than 60 days from the date of approval of petition. After march, my payroll has been regular and I have paystub for the last 4 months.
Now I am looking for H1 transfer to another employer. Is there a chance that USCIS might ask me for all the delayed payroll?
How many paystubs usually USCIS asks for?
Was I out of status for Jan/Feb because of the delay in payroll run?

    I appreciate the help.

    Thanks
    Raj

    >>> As long as you got paid with the pay slips showing correct dates, you are all good. The employer cannot process the payroll until the SSN is issued. This is not an issue.

    >>> Delayed payroll is not an issue. You can always explain that it took time to receive the SSN. But SSN usually takes only 2-3 weeks. Why did it take 2 months to process the pay slips?

How many paystubs usually USCIS asks for?
    >>> It depends. Usually 2-3 pay slips.

Was I out of status for Jan/Feb because of the delay in payroll run?
    >>> You were out of status from the date H1B got approved until you were not on job. You were okay for the period where you have proper pay slips. Were the pay slips generated with the correct dates even if they were processed late?
Not a legal advice. Use of this information is strictly at your own risk.
