Need some guidance on L1B to H1 B / H4

hi,

I am currently on H1b, my wife is working for an IT company on L1B visa. Her visa is ending in Nov,2012. We were initially planning to get her on H1B too but the cap for this year's H1 is already full. I wanted to know what other options do I have to keep my wife in the country with me ? I know L1 extension and exended i-94 are options but none of those are done yet.

You can file a COS from L1 to H4 (as your dependent) before her current I-94 expires. She won't be able to work once the H4 gets approved. Search and read the instruction to file form I-539 in uscis.gov.
