URGENT:- Need to Convert B2( Tourist) to H1B

Hello All,

I am in USA on Tourist Visa. I have already worked in USA on H1b earlier and Left US in 2010.

I completed my 4 years of H1B.

Now I got a Job offer and my employer want to convert my B2 visa/status to H1.

1) Is it possible to convert my B2 to H1 while I am in US. ?

2) Has any one done that. Please share your experience. Please share any information regarding this.

3) Are there any issues when you go for stamping in India.

The quota for 2012 is over, you need to wait till Apr 2013 to file new H1.

if you have already been cap counted in last 6 Years you would be cap exempt and use the old H1. Though difficult it is possible to convert from B2 to H1. You have to file the COS before your B2 I-94 expires and recommended to file it in premium to get the result within 15 days. This is my opinion not legal advice.

Hello,

I received my approval,visa in 2005 and landed US in June 2006.

My I-140 is clear and I am joining through the same Employer.

I heard that Once the COS is done. It is difficult to get the visa in India once you go for stamping.

Any one please share your experience.
