  • H1B Visa petition transfer: not having Petition number

    I have two scenarios that show my case.
    1- I had H1B visa that got expired in July 2011 from my first employer. This Visa was unused and got expired. Can I utilize by any means like renewal or non-Cap visa request?
    2- Now I have H1B petition approved from my second employer and I have quitted the employer on Apr 2012. I don’t have application no and petition no with me. My Petition got approved on Feb 2012 and is valid till Sep 2013. Could you please suggest me how can I move further for my Visa stamping from my Current third employer? How can i get the petition number? My current employer is ready to process Visa stamping.
    Please help me how can I take up these cases.

    As per my understanding you can use your previous H1B (for which stamping expired in July 2011), get it transfered (i.e. cap exempt filing) to the new employer and go for stamping again (subject to the condition that you have not utilized the whole 6 years ).

        Again I have a question.
        It is related to my first case as unused visa expired. Can I try for Visa stamping from any consultancy in India on my own expense if my current employer is not processing it?

          Someone has to sponsor your H1B. According to USCIS, employee cannot pay for H1B, it has to be the employer. If you go through a consultancy then you need to provide strong proof of employer-employee relationship.

          If you have cash to splash, its better to hire an immigration attorney and proceed.
