  • URGENT : Status of H1B extension

    Hi,

    My employer filed for my H1 extension and when I see the status on USCIS. Can you please let me know what does this mean and what is the next step?

    "On August 21, 2012, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations."

    This is a standard status message for all approved cases. Haven't you seen this before? So, yes, your case is approved. Wait for the approval notice in mail. Your employer/attorney should receive it in mail within a week or so. I'm still waiting for mine.

      Does this mean my H1B extension is approved or it is just one step? What is the following procedure?

        Depends on what your approval notice says. Wait to see it in the mail. Others could probably have a better insight about your case.

          I noticed Strange thing.

          In morning, I saw my application status was showing "Post Decision Activity" but now it has gone back to the status "Decision" showing below details

          On August 21, 2012, this I129 PETITION FOR A NONIMMIGRANT WORKER was approved and we sent you an e-mail notice. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

          During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.


          Has anybody faced such kind of issue? What should I understand as my petition status now?

            The same thing happened to me. I kept wondering what it was and then I read somewhere that for petitions with premium processing, the employer is notified by email first and then mail. You will see that the message says "sent you an e-mail notice." Ask your lawyer/employer if they received an email. Don't read too much into it.

              Mine was the same case. It went from Decision to post decison and back to decision. My attorney received the approval mail the very same day. It contained the details of your petition like Petition#,Petition name, validity date, I94# if applicable and so on. I am assuming the actual hard copy of I797 approval notice will reach within a weeks time. My petition was approved on 17th Aug.

                Waiting for H1B visa extension

                Hi,

                I have received the USCIS receipt notice by 05/22/2012 and still my Petition is in 'Intial review'. Do anyone have any clue of when this can be expected to approve.

                  My employer didn't disclose the details she saw in the emails. Weird, right? She is waiting for the official letter. Mine was approved on Aug. 15. Let me know when you receive yours.

                      same situation here....my I-129 for h1b extension of stay was filed in May 2012 too, and it's still pending and my I-94 expired....in this case if the extension os stay denied, will the presence since I-94 expiration date considered unlawful???
