    Hello,

    I have got 221g query on my h1b stamping and after waiting 5-6 months I got a response from the consulate that they unable to issue a visa this time.My visa got denied.

    I am transferring my h1 to new employer and need some help regarding filling DS-160 form
    Here are my questions which are taken from DS-160.

    1.Are you applying for the same type of visa? Yes Or No
    2.Has your U.S. Visa ever been cancelled or revoked?Yes Or No
    3.Have you ever been refused a U.S. Visa, been refused admission to the United States, or withdrawn your application for admission at the port of entry?
    Yes Or NO
    4.Has anyone ever filed an immigrant petition on your behalf with the United States Citizenship and Immigration Services?Yes Or No
    5.Previous Work/Education/Training Information NOTE: Provide your employment information for the last five years, if applicable.
    Were you previously employed? Yes No

    For questions 1,2,3,4,5 the answer is Yes for my case.If I select Yes, want to know what would be coming questions related to 1,2,3,4,5.
    What should I write in the DS-160 form for questions 1,2,3,4,5?

    Please give your inputs.Your response is highly appreciated.

    Answer to question 1 : If you are applying for a H1 again, say YES.
    Answer for question 2 :YES only if your visa was cancelled or revoked (means you were given a visa but it was cancelled later for some reason, ex: you move to a new client but dont file H1ammended petition.)
    Answer for question 3: YES in your case since your visa was refused.
    Answer to 4 : Not sure,
    Answer to 5 : If you were employed before, doesn't matter where. Since you are transferring your case, its a YES.

    Get help for DS 160. This makes or breaks your case. Also my replies were based on your data, recheck before putting blind faith. Good luck
