I am in 8th year of H1. Current extensions are based on approved I-140 (EB3). Priority date 2/2010.
Current H1 is valid till 10/2013.
My questions are:
1. If I change my employer NOW, what will be the pre requisite for H1 extension after 10/2013?
- Is there a possibility of H1 extension through new employer using my current I-140?
- If my Labor petition is still under process, can my new employer file for extension after 10/2013?
2. Is it true that if I have worked for more than 180 days after I-140 approval, I will own I-140 and my employer cannot cancel it?
