  • Opinion required : H1 Transfer immediately after H1 extension

    Hi All,

    I have just got my H1 extension done by my current employer.

    How safe it is to switch job now immediately and let new employer file my H1 transfer petition?

    I mean should I stick to my current employer for some more time before switching job so that I can avoid H1 transfer rejection?

    You can switch jobs immediately.

      My actual doubt is, if I switch job and apply for H1 transfer immediately after H1 extension, will it create any kind of doubts in USCIS and result in rejection of H1 transfer?

        Opinion required H1 transfer

        Hi All,

        I am having H1B visa wich I got it stamped on 7thMay 2012 and the petitioner is company A.
        It is valid till Sep 2014.But I didn't travel to US and recently I quit company A and joined company B.

        I have some queries
        1.Is Visa still valid?
        2.Is it possible to get it transfered to Company B?

        Please let me know as I don't want to waste this visa.

          1) You can immediately transfer
          2) About your doubt, what doubt do you think USCIS will be in? Do you think they take deep interest in how many jobs you change ?
          If the company transferring your H1 is shady, or the docs are not in order, you may get a RFE or denial. It is recommended to resign after your H1 is transferred.

          2) Yes (The transfer will be a new cap exempt petition anyway)
