H1B Transfer outside USA.

Hi All,


Am currently working with a Company '56T' based in india. I travelled on my L1B and stayed over a period close to 3 years.
After the expiray, my compnay filed for H1B, i received an approval and got my visa Stamped when i came back to India.

Now i hold a H1B stamped visa valid MARCH 10 - 2013. What are the legally possible ways for me to enter into USA.

I have an employer who is ready take transfer once i land in USA.
Can i travel with my current VISA.
Can i travel after my new employer files for a H1B tranfer and gets the receipt notice.

Please advise.

Your new employer will have to file the petition first and then you can use your existing Visa to travel there and work for that new employer.

If your current petitioner does not have a job for you in the US, it will be illegal to travel using their petition. Once you arrive in the US, you will have to work for that petitioner and without their paystubs, the new employer will not be able to obtain extension of status for you.
