  • H1b filed as change of status instead of consular along with L1-B extension

Hi, I really need somebody's help right now and I am very afraid of what will happen to my case. Here are the specifics:
    1) My L1B expired on Jan 27, 2012, we filed for an extension and got an RFE. Responded to the RFE and now 240 days will complete on 22 Sep 2012
    2) the company also applied for H1B as a change of status even though the L1-b was not valid at the time of filing (Jun7)

    My questions are:
    1) if my L1 extension is denied, will my H1B petition be also denied as it is COS and not consular processing? The folks from my immigration department were telling me that it would be approved (assuming all documentation is good) as Consular in case the L1 is denied, is this true?
    2) We responded to RFE on 30 Aug, should we stay in the country to wait out the result, or just leave at the end of 240 days period?
    3) how much time should we expect for the RFE response from USCIS.

I would appreciate the help you guys are providing in this tough time.

    Regards,
    Ram
