I am in a unique situation and am hoping to get your advise.
I have been in US on L1B since May 2007. After recapturing, my 5 years stay would end on October 1st.
My employer filed for H1 on June 1st and am yet to hear the decision. As many other MNCs, my employer is neither willing to give me the petition number nor do premium processing. I am worried that I would be accumulating illegal stay and / or be forced to leave US for stamping.
Can I file for H4 now (my wife is on H1) and wait for the decision on H1? Would USCIS cancel the H1? Is there a way to stay in US and wait for the decision on H1?
