  • H1-B visa extension

    I am currently working for client A from my current employer. my I-94 is expiring on nov 24th 2012 and my employer filed for extension in Aug 2012. (currently in initial Review state).

    Now my current project is getting over in Oct 2012 and i am being asked to relocate to other state for client B.

    In this case:

    - Can i move to different location for client B with current H1 B extension pending ?
    - Can my employer file a new extension request or change existing request with the Client B details?
    - can i submit the request as premium processing to get the result before my I-94 expiration date?

    Your employer will need to file new LCA and a petition amendment. Since one petition is in process, they would need to consult with a good lawyer on how to process this amendment. Premium is possible, but even then amendment will be necessary.

      Please find below update from my employer immigration team.

      No need to re-file if the client or location has been changed, just needs to get the LCA change if the new location is more than 50 miles in distance.
      Please note, if you have to relocate then you should update your address with USCIS by filing an AR-11.

        That used to be the norm in the past. But in last year or so USCIS has mandated petition amendments. Ask them to check with their lawyers or if they are the lawyers ask them to check recent requirements.

          Latest update:

          You can update your address in general with USCIS using AR-11, however, you should not change the address listed for extension application, as this will need to remain as Employer's address.
